The default position is Sole Proprietorship, but if you\u2019re going to employ anyone outside yourself, it\u2019s best to register as an LLC.<\/li>\n\n\n\n<li>Every LLC must have its own Registered Agent, someone who will receive all official tax correspondence from the government. Common question: <a href=\"https:\/\/www.llcuniversity.com\/can-i-be-my-own-registered-agent\/\"><em>Can I be my own Registered Agent for an LLC<\/em><\/a><em>? <\/em>It depends on your state, but generally hiring a third-party service is best.<\/li>\n\n\n\n<li>Also ensure you have an employer identification number, or EIN. You can request one for free on the IRS website. This number is necessary both for processing payroll and for <a href=\"https:\/\/www.tailorbrands.com\/llc-formation\/llc-taxes\">filing your LLC\u2019s taxes<\/a>.<\/li>\n<\/ul>\n\n\n\n<p>With these preliminary points out of the way, we\u2019re ready to take a closer look at how remote workers are taxed and some remote work tax implications.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Taxing Employees Who Work Remotely<\/h2>\n\n\n\n<p>When you have a more traditional work environment, one in which your employees all congregate in the same office each day and they all live and work in the same state, taxation is pretty clear cut. As an employer, you simply need to withhold state and federal income taxes that apply to your area. You may also need to withhold <a href=\"https:\/\/www.irs.gov\/taxtopics\/tc759\">FUTA<\/a> and other payroll taxes.<\/p>\n\n\n\n<p>If your employees all work remotely but are in the same state as your LLC, taxation works in much the same way. It\u2019s when you have remote employees who work in <em>different <\/em>states that things get a little complicated for remote employees and state taxes.<\/p>\n\n\n\n<p>Generally speaking, the state where your employee lives and works is the one that taxes them. As such, you\u2019ll need to coordinate with the labor and employment agencies within each of these states to make sure you\u2019re following all the right guidelines.<\/p>\n\n\n\n<p>Here\u2019s an example: Let\u2019s say your LLC is in Arizona, but you have an employee who works remotely from their home in Oregon. As an employer, it\u2019s your duty to withhold all state and local taxes that apply in Oregon, holding these taxes back from the employee\u2019s salary and benefits. You may also need to pay unemployment or other special taxes for that area.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dealing with Different Types of Remote Workers<\/h2>\n\n\n\n<p>Of course, it\u2019s important to recognize that there are different types of remote work, and each one can bring its own unique tax complications. Here\u2019s a quick rundown.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Commuter Employees<\/h3>\n\n\n\n<p>If your organization is based close to the state line, you may have some employees who live in one state but commute into your office periodically. These employees may work \u201cremotely,\u201d in a sense, and both employer and employee may be subject to tax obligations on <em>both <\/em>sides of the line. Some states offer reciprocal agreements to help avoid the burden of double taxation, which often looks like one state offering a tax credit to pay for the tax liabilities elsewhere. Again, this is something you\u2019ll want to double-check, as the specifics can vary from one place to the next.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Independent Contractors<\/h3>\n\n\n\n<p>You may also have some individuals who work for you as independent contractors, which is to say, on a <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-1099-misc\">1099 basis<\/a>. These workers are not considered to be employees in the eyes of the law, which means they are responsible for paying their own personal income taxes, to the state of their residence, on the basis of independent business ownership.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Employees Temporarily Working Out of State<\/h3>\n\n\n\n<p>We\u2019re mostly reflecting on employees who work remotely on a <em>permanent <\/em>basis, but what about those who are out of state temporarily? In some cases, these employees must file non-resident tax returns. However, different states have different stipulations to consider.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What About Taxable Employee Benefits?<\/h2>\n\n\n\n<p>Something else for business owners to consider: If you offer taxable employee benefits, which include different types of stipends, that adds a new wrinkle to your tax reporting. Specifically, you\u2019ll need to report the additional taxable income to whichever states require it. For some remote workers, this means reporting the additional taxable income to multiple states. This has a pronounced effect on taxable wages, withholdings, etc.<\/p>\n\n\n\n<p>The conversation about stipends is important because, in many cases, employers will need to reimburse their remote employees for the tools, supplies, and resources they need to do their work. Stipends represent one of the best ways to do so.
